Sub:- Revision of guidelines for considering placement under TBOP/BCR in respect of the Staff of SBCO.

Respected Madam,
Your kind attention is invited to the issue on the above subject by this association & pending since long.
The issues related with seniority of former UDC’s after merger the LDC’s& UDC”s which are decided by te Hon’ble Kolkatta CAT O.A.No- 1148/2003 dtd. 16.8.2004 & Hyderabad CAT O.A. No- 701 /2006 Dtd. 24.11.2006 for Seniority Pay Protection against their Juniors are yet to be granted to the affected SBCO Staff of All Circles. Such cases are pending since long.
The Reference of this Association Even No. Dtd. 20.March 2009 to grant such benefit to the SBCO staff as PLI & SBCO staff of Kolkatta is yet pending at your end due to the reason of pending SLP on this issue which is not responded by the Department. But this issue is neglected till this date. Even a single line reply is not received to the under signed on this issue after 19th Sept. 2006 Ref no- 22-9/99-PE-I.
This issue may be consider as natural justice before the implications of the MACPS recently issued by the DOPT O.M. No- 35034/3/2008-Estt(D) dtd 26th May 2009 in which such benefit of stepping up to the Seniors with juniors Pay is not accepted vide Para No- 10 of this Order.
As This issue is pending for implementation of Kolkatta & Hyderabad CAT judgment on the seniority issue & decided in favour of SBCO staff.
You are requested to look into the matter as a natural justice & grant Seniority Benefit against their Juniors to SBCO Staff of all Circles as maximum cases are pending since long in all circles after 17.5.2000 order in the issue of Smt.R.Prabhadevi Vs Union Of India & others dtd 8th March 1988 , which is prior issue than implementation of TBOP/BCR to SBCO and in Postal Side not related with SBCO issue.
Hope that you will consider this issue in the interest of the SBCO staff by granting benefit of Seniority to the UDC’s & others.
