General secretary at CHQ-
General secretary visited Delhi from 13th to 18th Dec. 2009. In this period meetings with Director (SR) on the associations verification process discussed on 14th Dec.2009. Verification process stayed by the different court stay orders. has no any progress. Non cooperation from all circle heads and harassment's of staff from local authorities discussed. Especially cases of A.P. Circle & Tamilnadu discussed. Assured for necessary action by the Director (SR).
On 15th & 16th Dec. meeting with DDG(F.S) on the issues faced by the different circles in the implementation of Project Arrow program by the local authorities. This issue is taken up for violation of rules & regulation by the local heads is taken by this association only. Matter about violation of rules & procedure is brought to the notice of the concerned. On which it is made clear from the DDG(F.S) & DDG(Tech) that no violation will be supported. In this regards the matter submitted by the association is under examination by the concerned.
The issue of staff shortage in SBCO for recruitment as per revision cases is put up to the DDG(Establishment). It is under consideration. The matter is also taken with concerned Ministry level by the association.
Pay protection cases of UDC's at par with juniors( LDC's) as per Kolkatta CAT case & Hyderabad CAT case discussed with concerned. The Department has not responded to SLP in Supreme Court since Feb 2009 & it is Defaulter in the case. The matter delayed in the court. Necessary action to finalize the issue is in process for favor implementation by the association.
To run the CHQ activities we are facing funds problem. All circle secretaries and office bearers should make their efforts to collect donations , subscriptions, from members to credit for CHQ. It is very difficult to maintain our position at CHQ level.

Appeal for collecting outcome of project arrow program for submission to the DTE
Along with NAPE Group C through FNPO federation it is proposed to put the outcome of Project Arrow program from different circles. Staff shortage , Violation of Rules & Procedure & Involvement of Staff for same violations in different cases in different circles are the main issues. All such grovences are to be put up to the DTE ,Ministry level. NAPE Gen.Secretary Shri. D. Kishan Rao, Deputy Secretary General FNPO & Gen Secretary IPSBCO staff Assn are going to prepare detail draft for submission through FNPO federation. Views , suggestions along with problems , issues are invited from all before 12th Dec.2009. All gen Secretaries will be at Delhi after 13th Dec.2009 to put up this matter at DTE & ministry level- S.P. Kulkarni, Gen Secretary.

Modified ACP proposal-
Today Joint Secretary JS & FA cleared the MACP file & it is sent to the Secretary Department of Posts for approval. It is likely to be cleared tomorrow.
GDS Issue- it is not cleared up by the cabinet today. likely it will be come up in the next meeting on 24 Sept.2009. Postal JCA will meet on 21 st to chalk out strategy. Todat Secretary General issued telegram to the Cabinet Secretary Shri. Chandra Shekhar to take this issue in Cabinet meeting considering resentment among the staff to avoide indefinite strike by the Postal Employees.

GDS Pay Commission issue-
On 15 th Sept.2009 Cabinet Secretary asked to the Department of Posts to get clearance from the Chief Election Commission to accept GDS Pay Commission. The Special officer from Department approached Chief election commission for getting the clearance from election commission. Due to high political pressure from federation side Election commission has given clearance on 16th Sept.2009 at 4.00 P.M.for announcement of GDS orders and to take its decision in cabinet meeting. In the cabinet meeting of 17th Sept.2009 it will be positively decided, we hope positively that decision of GDS will be taken in this meeting.Efforts made by the federation at CHQ level must be appreciated for this early clearance from Election commission.

AISBCE Circle Secretary transferred- A.P. Circle issue
AISBCE Circle Secretary A.P. Circle who was working at R.O. as PA AOICO since 20 years utilizing his portfolio as C.S. A.P. Circle is transffred out from R.O after reference from this CHQ. Complaints were received from Staff of A.P. Circle for his dictatorship & harrashment towards staff. Also matters about favouritism towards some officials was reported to this CHQ. By using his portfolio he was misleading to the DPS/PMG. The matter was taken up with CPMG A.P. Circle. After directons from DTE he is transferred outside R.O. CHQ is waiting such instances and trying to safeguard SBCO staff from monopoly of some antistaff elements.

Subject:Payment of second instalment of arrears on account of implementation of Sixth Central Pay Commission's recommendations.
As communicated vide this Department's Resolution No.l/l/2008-IC dated 29th August, 2008, the Government had decided that the arrears on account of implementation of Sixth Central Pay Commission's recommendations will be paid in cash in two instalments - first instalment of 40% during the year 2008-09 and the remaining 60% in the financial year 2009-10. The first installment bas already been paid in 2008-09. It has now been decided that the remaining 60% of arrears may now be paid to the concerned Government servants.2.Further, as already stipulated vide this Department's O.M. No (2)/ EV/2008 dated 17th August, 2009,(2.23MB) in the case of post-Ol.01.2004 entrants into the Central Government, the second instalment of arrears may be released only after individual application forms for registration to the New Pension Scheme have been obtained by the DDO/PAO from the concerned Government servant.3. As in the case of the first instalment of arrears, Government servants will be permitted to deposit their arrears in their GPF Accounts. Though not mandated, Government servants are encouraged to deposit their arrears in their GPF accounts.

Meeting at DAK Bhawan with MEMBER (Planning) & DDG (Estt) & Direcor (Planning) & Director (SPN).
Today on 11th August 2009 Shri. T.N. Rahate President FNPO & Gen Secretary NUPE-Postmen & group D along with Shri. S.P. Kulkarni General Secretary Indian Postal SBCO Staff Association met with following Officers to discuss the different problems of Postmen & Group D and other Employees. The Issues and output of the meetings with DTE Officers put up here with-
1) Meeting With Shri. R.K.Singh Member (P):- Issue regarding Review of Time Factor of Postmen discussed in details to implement new norm as early as possible. Member (P) assured its implementation within 15 days and asked to remind after 15 days about this issue.
On the issue of Recruitment of Peon & Mail Peon (Multi Skilled Group C) in the existing vacancies from GDS since 2006, 2007 & 2008. It is assured to fill up vacancies of 2009 & orders will issued earlier. For the vacancies of 2006 & 2007 the matter will be taken up with (Screening Committee) Secretary Expenditure. Also directed to take up this issue with appreciate authority for better results.
Placement of Non matriculate Group D employees in PB-1 with effect from 1.1.2006- order not implemented in Maharashtra Delhi and some other circles is pointed out the Member (P) on which it is directed to DDG (Esst) to look in the matter and to settle the issue amicably.
In discussion of Pay fixation issue of Group D Officials retired after 1.1.2006 the benefit of PB-1 is not granted till this date pointed out to the Member (P) on which Member (P) assured to call report from all circles and suitable action will be taken earlier.
On the issue of Circulation of New Syllabus for the Postmen Examination and LGO Examination for promotion to cadre of PA /SA regarding an increase number of chances.-Member (P) assured that the issue will be examined properly and circulated shortly.
Issue of Karnataka circle for stoppage of speed Posts delivery articles by GDS Employees through Nodal Delivery System pointed out to the Member (P). On which Member (P) assured to call report on the subject & assured for proper action.
2) Meting with Shri. Salim Haque DDG (P):-filling up vacancies of Peon & Mail peon in the existing vacancies and to circulate calendar of Examination for Postmen & PA’s, LGO’s and all cadre.- it is assured to take proper action shortly.
3) On the issue of Project Arrow, Business development the meeting with Shri. Kaushal Kishore General Manager BD & MD, Shri. John Samuel Manager Speed Post was held to put up the present issues on the subject faced by the employees. The Officers assured for healthy business with cooperation of the unions is expected by the Department and assured to provide good atmosphere to the Postmen and all staff to involve in the mission to develop the business.
4) Funds provisions for Computer advances, Provision for supply of new furniture to the Postmen and flooring in delivery halls such subjects discussed with Ms Smruti Sharan Director (SPN) , Ms Madhumita Das Director (Corporate Planning), Ms Ainendrui Anurag Director (Planning) & Shri. P.N. Ranjit Director (Globle Business) in a healthy atmosphere and responded favorably by the above officers.
5) Meeting with Shri. Subhash Chander Director (SR) :- Assured to arrange periodical meeting with Secretary (P) & Members for the burning issues put by the General secretaries & Secretary General Shortly. Also issue of Fresh Verification process for Recognition will be decided by vacating Stay of the different courts explained by the Director (SR).
Note to ALL: - Divisional Secretaries / Circle Secretaries may be alert to face fresh Verification Process for Recognition of the Service Associations shortly. We should prepare ourselves to get maximum membership for Recognition. Soon the program will be announced.
BRIEF NEWS: - GDS PAY Commission Recommendations note submitted today morning to the Cabinet & DOPT for final approval.. Within 2/3 week it will be finalized.

General Secretary's Tour & Meetings with Officers.

Today on 10th Aug.2009 Shri T.N. Rahate President FNPO & General Secretary NUPE-P-IV with Shri S.P. Kulkarni General Secretary Indian Postal SBCO staff association met to Shri. A.K. Sharma DDG (Estt) & discussed the following issues.
1) Modified ACP Promotion Scheme- Almost Order for MACP is ready. Only Issue of MACP about Drivers cadre is under discussion. Immediately it will be finalized and submitted to JS & FA for approval. From the discussions it is cleared that the benefit of MACP will be granted to all employees after completion of 10, 20 & 30 years service. Three financial up-gradations will be granted to all. No hurdle for TBOP & BCR officials to complete 10 years in the same cadre. . Considering TBOP & BCR qualifying service after completion of 20 & 30 years benefit will be granted that is only after 4 years of TBOP & BCR Benefit of 20 & 30 years will be granted. Orders will be effected w.e.f. 1 St Sept. 2008 onwards. For example In case of Promotions from one cadre to other after 8 years he will be granted next promotion after 10 years i.e. he will get benefit of second promotion after 18 years instead of 20 years. Orders will be issued shortly.
2) Regarding GDS Pay Commission: - Note for Cabinet is submitted by the Department. It will be finalized up to the First week of Sept.2009... Benefit of revised pay will be granted w.e.f. 1st Jan. 2006 to the GDS employees.
3) Arrears of 60 % CPC second installment: - It will be paid in the second week of Sept. 2009 before Dipawali festival.
4) New norms for Postmen - Revised norms will finalized shortly.
5) Implementation of orders regarding placement of non matriculate Group D employees in the Pay Band PB-1 with effect from 1.1.2006- it is brought to the notice that these orders are not implemented in all circles. It is assured to implement it immediately.
Meeting with Shri. D.K.Budki Member (Planning):- Discussion about the Departmental proposals & Role of unions considering the constructive role & necessity of cooperation of unions & administration discussed in detail. The views of the federation & unions /associations are appreciated by the Member (Planning). He assured every cooperation to the federation.
Meeting with Director (Planning):- Details discussion about GDS was held with Shri R.K. Mishra Director Planning. It is made clear by the director that more incentive through NREGS scheme is proposed to the GDS employees.
Meeting with Director (SPN):- Provision to the postmen to appear to LGO Exam Dec. 2008 for Maharashtra Circle clarification for eligibility for appearing examination will be given earlier as per provisions.

The reply received to the association from the Department vide reference No- 116 -19/09- SB from the Department of Posts ( F S Division) Dak bhavan dtd 6.7.2009 is produced here. Annual direct rucruitment for 2006 & 2007- 5190 posts sanctioned
Annual Direct Recruitment for the years 2006 & 2007 - Total 5190 posts sanctioned.
Members may be aware that the CHQ has been pressing the department to fill up the ADRs for the years 2006-2007 when the department issued ADR for the year 2008. The Department of Posts had taken up this issue with the DoP&T for revival of the posts for the year 2006 and 2007 and the DoP&T approved the same. Now. totally 5190 posts are sanctioned under the ADR plan for the years 2006 & 2007. The Department will apportion posts cadre wise and is expected to issue orders next week.
The CHQ urged the Department now to fill up ADR vacancies for the year 2006, 2007, 2008 and even for this year 2009 in one recruitment in the coming months. Members may please note that for the year 2009 all the vacancies can be filled up whereas for other years only 1/3rd posts can be filled up.

Modified ACP- implemention regarding-
Modified ACP orders for Postal Employees are under preparation. The DDG informed us that the orders will be a comprehensive one with full details of fixation models for different categories and that is why the preparation is taking some time. After the orders are prepared the same will be submitted to the consent of the JS&FA and then orders will be issued by the Directorate for implementation. Contrary to the earlier information, the DDG [Estt] asserted that there appears to be no need to submit the orders for approval of the DOPT and clearance by JS&FA would be sufficient. It is expected that another 15 days may take for finalization of the orders and we can expect the same to be issued next month.

The Postal JCA of NFPE and FNPO Federations call upon the entirety of Postal Employees to organise a massive Dharna jointly under the banner of Joint Council of Action on 29.06.2009 at the level of Divisions / Branches for calling the attention of the Department of Posts to the following burning issues. As far as the Delhi Circle is concerned, there shall be a massive demonstration in front of Dak Bhawan during lunch hour on 3.7.2009, the first day of Budget Session of Parliament. A Memorandum on the following items shall be submitted to the Honourable Minister of Communications & IT and Honourable Minister of State for Communications & IT by the JCA on 3.7.2009.
The Burning issues that shall receive focus:
Early implementation of GDS Committee recommendations with the suggestions of staff side duly incorporated.
End discrimination in bonus quantum ceiling between regular and GDS as per the Bonus Act amendment.
Remove the arbitrary cap of 60 days in PLB for Postal Employees.
Fill up ADR vacancies of 2005-06 & 2006-07 in all wings and of all cadres including Multi Skilled employees.
Expedite Cadre Review of all cadres in Department of Posts.
Stop abolition of Postmen posts and beats and stop harassment of delivery staff and instructions in violation of P&T Manuals in Project Arrow Offices.
Cancel the order for compulsory pay disbursement through bank cheques and direct credit system.
Re-fix the eligibility for OTA proportionately to the 6th CPC wage level and clear all pending OTA bills.
Re-fix the wages of all Casual labourers and Part Time Contingent / RRR employees on the basis of the 6th CPC wages.
Grant Child Care Leave to all eligible Women Employees.

Sub :- Violation of procedure in P.O. Saving Bank work /SBCO procedure by the DDG(Technology) & DDG (F/S) branch and actions for non following procedures in different circles by concerned officers.
Respected Madam / Sir,
It is observed and reported by the circle branches of all circles that local authorities are following instructions issued by the DDG (Technology) and DDG (F/S) branch under the name of plan targets & under project arrow program to cope up the pending work of PO Saving Bank in SB/ RD/ MIS & in SBCO branches. It is not following the approved procedures & Rules and Regulations on the subject. Different software’s used for working in Saving Bank & SBCO which are not as per approved procedures and rules on the subject and not meet with the procedure to put up proper reporting as per provisions according to the Departmental procedure. However work is compelled by the local heads as SP’s /SSP’s / DPS’s / PMG’s/ CPMG’s vide following the instructions by the DTE to prove the targets.
However for any mistakes or fault the staff / employee performing the same work as per their directions are held responsible for the fault detected. More over the staff has to face disciplinary actions up to suspensions, huge recoveries, stoppage of increments for not performing the same work as per Rules & regulations & procedure laid down , approved by the Department of Post & Postal Board in the same issue.
At the same time the IP’s /ASP’s / SPO’s/ SSP’s who are visiting the BO’s/ S.O’s/H.O.’s for inspections, Visits again & again with expenditure of TA /DA who are supposed to check the working of the PO branch for RD / SB/ MIS work but they are not considered for such loss , fault detected in PO’s. Only the common employee is targeted for completion of work with violating the procedures, Rules & regulations approved by the Postal Board & Finance ministry and again he is targeted for actions by the same authorities for lapses & faults in the same working.
Considering the facts you are requested to look into the matter not to involve the employee in disciplinary cases when he has worked for plan target or project arrow program vide directions of the local authorities as SP/SSP/DPS/PMG/CPMG orders. Otherwise any violation of rules, Regulations & procedure laid down should be strictly avoided by all. Staff should not be compelled for violation of procedures. If so instructions may be issued to all concerned to stop violation of procedure laid down by the Department / Finance etc. in the routine working of P.O. Saving Bank & in SBCO branches.

Seniority benefit to UDC's/Considering placement under TBOP/BCR in respect of SBCO staff.
Issue of Implementation of Kolkatta CAT O.A. No- 1148/2003 dtd 16.8.2004 & hyderabad CAT O.A No- 701/2006 dtd 24.11.2006 for seniority /Pay protection against their juniors was taken up by this association only vide references published through this blog time to time.
Recent reference No- SBCO /FNPO /09 dtd 2.6.2009 vide its previous references is on this blog elsewhere.
The latest development in the issue is informed by the concerned Establishment branch, PE-I section that in this case Report from Kolkatta CPMG about the implementation of CAT order for Kolkatta PLI & SBCO Staff is called for. After receving the report positively the same order will be made applicable to all SBCO Staff in all circle as proposed by this association.

According to learned counsel for the petitioner, the said communication dated 17th April, 2009 was not sent to the petitioner – association and when petitioner-association came to known about the same, the petitioner-association requested the Chief Post Master, Rajasthan, Jaipur for giving copy of the communication Annex, P/4 dated 17th April, 2009 vide letter dated 12th May, 2009. On this request, the communicated dated 17th April, 2009 was given to the petitioner-association and the petitioner-association by his has not been given reasonable opportunity, rather say, reasonable time to comply with the conditions of sending the letters of authorization as required by Annex, P/4.
Looking to the totality of the facts of the case, Issue notice to the respondents for final disposal.

No- 701 /2006 Dtd. 24.11.2006 for Seniority Pay Protection against their Juniors are yet to be granted to the affected SBCO Staff of All Circles. Such cases are pending since long.
The Reference of this Association Even No. Dtd. 20.March 2009 to grant such benefit to the SBCO staff as PLI & SBCO staff of Kolkatta is yet pending at your end due to the reason of pending SLP on this issue which is not responded by the Department. But this issue is neglected till this date. Even a single line reply is not received to the under signed on this issue after 19th Sept. 2006 Ref no- 22-9/99-PE-I.

Modified ACP Scheme( MACPS) for the central Govt. Civilian Employees-
Federation has already given consent for 3 ACP scheme to the Postal Employees instead of TBOP/BCR. Ministry of Personnel, PG & Pension , Dept. Of Personnel & TRG have issued OM No- 35034/3/2008-Estt.(D) dated May 19, 2009 on MACPs.( Link is given to download these orders in this blog). Now It is requested by the Department of Post to Federations & all General Secretaries to go through the Scheme and its implications and asked to give consent for switching over the ACP Scheme for the employees of department of Posts as earliest vefore 5Th June 2009 with Ref letter No- 22-1/2009-PE.I(PCC) dtd.26th May 2009 by the Department of Posts.

FNPO Federal Congress was held on 22 to 25 th May 2009. I attended . The issue of Project arrow & Violation of present Rules & regulation by the CPMG/PMG/DPS/SSP & Local officers to create rosy picture neglecting Heavy Staff Shortage & Heavy pendancy of work. The issues of Disciplinary actions by these authorities considering same rules , Regulations & Procedure. The issue is already taken up by this association with DDG(F/S), & Secretary (P). The issue supported by NUPE-Group C & Secretary General FNPO. Now this matter will be taken up at all level to save interest of the Staff. Action will be taken up to stop such irregular working under the name of project arrow program & stop violation & threatening of Postal Employees. We are succeed to put up up this issue for immidiate action at Secretary (P) Level by all General Secretaies. Report of Federal Congress will be issued by the federation soon.

Verification Process Stayed by the Jodhpur High Court
It is learnt that Hon'ble High Court of Jodhpur Stayed the Verification process for Recognition by the order today for the BPEF federation. The Membership Verfication Process for Recognition of service associations in the Department of Posts which was in process vide DTE Ref No- 13.4.2007-SR Dtd. 17.4.2009 . Orders of the Hon'ble High Court are awaited. Also details are yet to clear.It is served to the Department today.

As many posts in HSG I are at present lying vacant in various Postal Circles for want of finalization of Recruitment Rules, it was proposed to the Department of Personnel & Training to allow the Department to fill up the existing vacant posts in HSG I as a one time measure on ad-hoc basis from amongst officers holding the HSG II norm based post (without prescription of any minimum service in HSG II). The DoP&T have since agreed as a special case to allow the Department to fill up the existing vacancies by promotion on purely ad hoc basis from amongst the officers holding HSG II norm based posts on regular basis (without prescription of any minimum service in HSG II), for a period of one year or till the Recruitment Rules are notified and appointments are made according to the revised Recruitment Rules, whichever is earlier.
3. In view of the above, it is requested that the Circles may take following action: -
(i) Ad-hoc promotions made as per instructions contained in the Department's letter of even number dated 20-11-2006 in HSG I may be further continued for a period of one year i.e till. 19th May 2010 or till the Recruitment Rules are finalized and regular arrangements are made in accordance with that, whichever is earlier
(ii) Fill up existing vacancies by promotion on purely ad hoc basis from amongst the officers holding HSG II norm based posts on regular basis (without prescription of any minimum service in HSG –II), for a period of one year or till the Recruitment Rules are notified and appointments are made according to the revised Recruitment Rules, whichever is earlier.
(iii) The resultant chain vacancies in HSG II, LSG etc, may be filled up by promotion on ad-hoc basis for a period not exceeding one year as per the instructions contained in DoP&T OMs No. 28036/8/87-ESTT. (D) dt. 30.03.1988 and AB. 14017/54/2003-Estt (RR) dt. 04.12.2003 circulated by this Department vide letters No. 6-6/88-SPB. II dt. 05.05.1988 and 137-2/2004-SPB.II dt. 13/14.01.2004 respectively. Any extension in the ad-hoc promotions so made would need the prior approval of DoP&T.

I am directed to refer to this Department's letter of even number dated 2nd December 2008 and 10th December 2008 regarding continuation of ad-hoc promotions made in the cadre of HSG I and to say that it has been decided with the approval of Department of Personnel & Training to continue the said ad-hoc arrangements for a further period of one year i.e till 19th May 2010 or till the Recruitment Rules are finalized and regular arrangements are made in accordance with that, whichever is earlier.
2. Gen Secretary Tour to Chennai & Karnataka
Gen Secretary along with CHQ treasurer Shri G.G. Sankapal visted Banglore ( KNT) on 28th April 09 for the issues of KNT circle . Visted Circle office. Meeting with CPMG, Shri. M.P. rajan , PMG, BD shri. Vasumitra for the SBCO issues. responded positively. also vited to banglore GPO in connection with Verification process to get maximum membership.
on 29 th attended for CWC/ CHQ & Federation working committee meeting. At the same venue the CWC/Gen body meeting of Tamilnadu was called by the Shri S Sambandan C/S T.N. circle. New CWC elected as Shri. N. Sakkarai President & Shri. S. sambandan Circle Secretary. Along with new C/S & President meeting was held with Shri S.K. Chakraborty CPMG T.N. Circle for the issues of T.N. Circle.Then Meeting with DPS & Sr. A.O.in satisfactory results.
G/S returned to Kolhapur on 1st of May09.

UDC'sPlacement under TBOP/BCR-Kolkatta/Hyderabad Court Case issue-regarding implementation -Ref to DTE

Ref No- This assn letter No- Dtd.BPEF/SBCO/06 dtd 9.8.2006 on which reply received from the Department Vide Letter No- 22-9/99-PE-I dtd 19th Sept. 2006 by PE-I section o/o the DTE about pending SLP in Supreme court against Kolkatta CAT O.A. No- 1148/2003 &
Hyderabad CAT O.A.No- 701/2006 Judgment Dtd 24.11.2006 on the same issue.
Respected Madam ,
With reference to judgment delivered by the Kolkatta CAT O.A. No- 1148/2003 dtd. 16.8.2004 in fever of UDC’s , SBCO staff for the placement under TBOP/BCR in respect of the staff of SBCO vide TBOP/BCR orders issued by the Department in 1991 for the SBCO staff under different circumstances with cadre restructuring by merging LDC & UDC’s as PA(SBCO). The en-block seniority & to maintain its identity were the main clauses in the orders. However these orders are super seated by the Departmental orders No- 22-6 /2000-PE-I Dtd 17.5 .2000. So SLP was filed by the Department. till this date no Kolkatta judgment is implemented on account of pending SLP. It is intimated by the Department above reference dtd 19th Sept.2006 to the undersigned.
In this connection it is pointed out by the Staff of Andhra Pradesh circle & West Bengal circle that in the similar issue , Case & vide judgment of the Kolkatta CAT for the postal life Insurance , Kolkatta , Staff of Director PLI vide O.A. No- 877/2004 vide approval by the CPMG , Kolkatta, & DTE in the matter the staff was considered for placement under TBOP/BCR against their juniors as per Kolkatta CAT verdict in O.A. No- 877/2004 provisionally though the SLP of the Department is pending at Supreme court on the same issue.
In this case though SLP was in process the DTE, CPMG approved the placement of PLI O/O the Director , PLI Kolkatta provisionally till the judgment of the SLP and issued orders of the Staff of PLI..
But for the same issue, case & judgment the issues of SBCO staff are not considered for placement with their juniors in all circles. Is it natural justice ?
In this case it is pointed out that-
1) TBOP/BCR granted in different situation. TBOP to postal staff granted in 1983. Stating SBCO is not operative as it is working for Audit & Accounts(Administrative). Audit & Accounts granted 80:20 Promotion in 1986 but again SBCO was not considered for that stating SBCO is not administrative as it is working with operative Postal side. As Such SBCO was kept deprived either benefit of Postal (TBOP) or from 80:20 promotion as Administrative. After 8-9 years in 1991 SBCO staff considered for TBOP & BCR with Restructuring /Merger of LDC& UDC as PA SBCO & enblock seniority benefit granted by the orders in 1991.
2) The order to deny such seniority /placement benefit vide Departmental order No 22-6/2000-PE-I dtd 17.5.2000 is not related to SBCO staff. These orders are issued in pursuance of judgment of Hon’ble Supreme Court dated 8Th March 1988 in the case of R. Prabhadevi & others Vs Union of India & others. The case was not related to SBCO’s TBOP/BCR issue as in its TBOP/BCR orders the seniority benefit is accepted as there was restructuring of two cadres. And vide these orders it is stated that past cases should not be opened as they were granted the seniority benefit, but in future no such benefit will be granted. This cannot be natural justice.
3) More over for one wing /PLI Staff of Kolkata has granted the benefit of such orders & provisionally without waiting SLP decision from the Supreme Court the staff is ordered by the Director PLI with the approval of CPMG , West Bengal with the approval by DTE Delhi. 4) Again on the same issue Hyderabad O.A. No- 701/2006 dtd 24.11.2006 delivered the same judgment to grant such benefit to the SBCO staff.
Considering all above you are requested to look into the matter in the light of the natural justice and grant the benefit of placement under TBOP/BCR in respect SBCO staff vide Kolkatta O.A. No- 1148/2003 judgment 16.8.2004 & Hyderabad O.A. Hyderabad CAT O.A.No- 701/2006 Judgment Dtd 24.11.2006 on the same issue.
Respected Madam ,
With reference to judgment delivered by the Kolkatta CAT O.A. No- 1148/2003 dtd. 16.8.2004 in fever of UDC’s , SBCO staff for the placement under TBOP/BCR in respect of the staff of SBCO vide TBOP/BCR orders issued by the Department in 1991 for the SBCO staff under different circumstances with cadre restructuring by merging LDC & UDC’s as PA(SBCO). The en-block seniority & to maintain its identity were the main clauses in the orders. However these orders are super seated by the Departmental orders No- 22-6 /2000-PE-I Dtd 17.5 .2000. So SLP was filed by the Department. till this date no Kolkatta judgment is implemented on account of pending SLP. It is intimated by the Department above reference dtd 19th Sept.2006 to the undersigned.
In this connection it is pointed out by the Staff of Andhra Pradesh circle & West Bengal circle that in the similar issue , Case & vide judgment of the Kolkatta CAT for the postal life Insurance , Kolkatta , Staff of Director PLI vide O.A. No- 877/2004 vide approval by the CPMG , Kolkatta, & DTE in the matter the staff was considered for placement under TBOP/BCR against their juniors as per Kolkatta CAT verdict in O.A. No- 877/2004 provisionally though the SLP of the Department is pending at Supreme court on the same issue.
In this case though SLP was in process the DTE, CPMG approved the placement of PLI O/O the Director , PLI Kolkatta provisionally till the judgment of the SLP and issued orders of the Staff of PLI..
But for the same issue, case & judgment the issues of SBCO staff are not considered for placement with their juniors in all circles. Is it natural justice ?
In this case it is pointed out that-
1) TBOP/BCR granted in different situation. TBOP to postal staff granted in 1983. Stating SBCO is not operative as it is working for Audit & Accounts(Administrative). Audit & Accounts granted 80:20 Promotion in 1986 but again SBCO was not considered for that stating SBCO is not administrative as it is working with operative Postal side. As Such SBCO was kept deprived either benefit of Postal (TBOP) or from 80:20 promotion as Administrative. After 8-9 years in 1991 SBCO staff considered for TBOP & BCR with Restructuring /Merger of LDC& UDC as PA SBCO & enblock seniority benefit granted by the orders in 1991.

FLASH NEWS- TBOP/BCR Equal to LSG/HSG-II- Supreme Court.
Chennai CAT had given verdict about TBOP/BCR is not mere Financial Upgradation but it is equal to LSG & HSG-II. Department had filed SLP in the Suprem Court Delhi, against the decision. The SLP is dismissed by the Suprem Court clearing the TBOP/BCR is equal to LSG/HSG-II. Jugdjment is awaited.

The undersigned is directed to refer to this Ministry's office memorandum No-1(3)/2008-E-II(B) dated 29th August, 2008 on the subject mentioned above and to state that the President is pleased to state that the Dearness Allowance payble to Central Government Employees shall be enhanced from the existing rate of 16% to 22 % with effect from 1St January 2009.

Discontinuance of V2SBCO Software Regarding
On this subject matter was taken up with Directorate to continue V2SBCO software in SBCO for
maintaning it's identity. It is accepted by the Department.Referance received on the subject is
put up here. In this regard it is pointed out that so called AISBCE union leadership is trying its level best to accept to work in Sanchay Post software by SBCO staff with Postal operative staff. leading to merger of SBCO with Po staff. It will loose check over PO Saving Bank work and SBCO's identity as internal Audit.Up to this date So called AISBCE union was not aware about the Banking proposal of Postal department. Always it is reflected in their Circulars that there is no such proposal of the Govt for separate PO Saving Bank. But now General Secretary of the same association is trying for core banking through Sanchay Post for the Department as He is working as System Manager in Madurai. But working in Sanchay Post for Data feeding with PO operative Staff will lost SBCO's identity. This Union has not any future plans for the Staff of SBCO no any idea for betterment of staff of SBCO. But one general secretary of so called Recognised union (AISBCEunion) is playing with future of SBCO staff without any constructive proposals for staff of SBCO. It can be observed by the staff. They can ask to him as - What is the role played by him in 6th CPC? Why he was not called by 6thCPC ? Has he given any proposal regarding Saving Bank? Only he is trying to merge SBCO with PO Staff by working in Sanchay Post and compelling SBCO to work in the same with PO operative staff. Our association has taken up this issue and stopped the orders issued by the DTE to work SBCO in Sanchay posts and utilization of SBCO staff for data feeding work. For continuation of V2SBCO software the matter is cleared by the DTE vide ots letter to the G/S,dtd 5.3.2009 refering Dte D.O. letter Dtd.27.2 /2.3.2009 is put up here . The ant worker policy of the so called AISBCE unionmay be highlighted to all units for survival of SBCO staff.

Reverification of Membership for Recognition of Service Associations.
Hon'ble Chennai high court delivered its judgment on 6.1.2009 and directed to the department of Posts to issue fresh notification towards the recognition of trade unions. As per relevent rules and decide the same withing 4 months. The court had directed the work of scrutiny of membership applications to be entrusted to an independent officer in the rank of Divisional Superintendent instead of DDO's.
The Department had sent fresh proposal in accordance with the judgment to the DOP&T and got approved. There is another Stay order of the Chennai High Court by AIRMS association with regard to the re-verification process in April 2008. Hence the file is sent to Law Ministry for its opinion. After receiving it from Law Ministry , The Department may go for fresh Reverification for recognition of service associations.

GDS Gopinath Committee issue.
GDS committee report is still pending with JS & FA, not submitted to MOF. NFPE GDS with support of all affiliated NFPE associations has decided for agitational program. GDS Bonus issue
Issue of GDS bonus ceiling not accepted by the Finance and ordered to recover excess paid bonus from GDS. Matter is taken with Prime Minister , Finance Minister to stop recoveries and to grant bonus as per Rs.3500/- to GDS by the NUGDS General secretary Shri. Muralidharan.
The strike call by the AIPED from 3.3.2009 on the charter of demands with NFPE affiliated associations.
FNPO & its affiliated associations will not participate such action. Positively GDS commission will announce before 2.3.2009. The call for strike by NFPE again & again is only political drama as before.

Setting up of Departmental Anomaly Committee of Dept.of Posts
In accordance with the instructions in the OM No- 11/2/2008-JCA dated 12.01.2009 of the DOPT , New Delhi appropriate Anomaly Committees should be set up by each Ministry / Department to settle the anomalies arising out of the implementation of the 6Th CPC recommendations.
Accordingly , Deptt.Of Posts has decided to set up a Departmental Anomaly Committee comprising of representatives from Official Side and Staff side. There will be 7 members from staff side in the ratio of 5:2 i.e. 5 from NFPE & 2 from NPO.
Secretary Generals of both unions are requested to intimate names of staff side representatives from federations within fortnight.
Departmental Anomaly committee shall receive the anomolies through secretary of the staff side.

GDS-Bonus recovered orders by Finance.
Finance ministry not agreed to enhance bonus ceiling of GDS employees 2500 to 3500 as regular employees. Recovery of extra paid bonus to the GDS ordered by the Finance Ministry.

Upgradation of Sanchay post SBCO module-
Meeting with Shri. VasumitraDDG(F.S) on 13th Jan. 2008 regarding use of V2SBCO software in SBCO or Sanchay Post, SBCO module Gen Secretary Put up the difference in both software & working of SBCO in details. The DDG(FS) DTE cleared that V2SBCO will not discontinued till the upgradation of sanchay Post SBCO module till it will fullproof as V2SBCO. Instructions to continue V2SBCO issued to the concerned.
Work shop of at SDC Chennai was held on 21-22 Jan 2008 in this regards. DTE has adressed to attend this workshop with suggestions in this regards. Shri. S. Samanthan Circle Secretary Tamilnadu deputed to attend this meeting by the General Secretary. Shri. Kawaljit Sing ASP(SB/SC) O/o the DTE is dealing the issue to upgrade Sanchay Post SBCO module as V2SBCO with fullproof functions. Suggestions put up by the associations are welcomed by the DTE/ DDG(FS).Till upgradation of this Sanchay Post SBCO module V2SBCO will use in SBCO.

Reverification of membership
The Secretary General, IPSBCO STAFF union reports that in a case filed by Bharatiya Unions long back in Chennai High Court, judgment was delivered recently to the effect that the applicant Unions should submit the membership applications to the Head of the Units instead of DDOs. Await further details.
